The “Ethics and Conflicts of Interest” course reviews typical situations encountered by practitioners who close real estate transactions that involve possible conflicts of interest. Business referrals, issuing title insurance policies while representing one party, and conflicts between the parties into which the closing agent may be brought, are all discussed. The duties of a closing agent to the parties, including as a fiduciary and as a title insurance issuing agent, are also reviewed.

“TITLE INSURANCE COVERAGE” reviews typically misunderstood title insurance coverage beliefs, such as whether an owner’s policy insures the marital status of the insureds and whether a loan policy becomes an owner’s policy after the insured lender takes title after foreclosure. This seminar also includes a discussion about title insurance policy coverage for unrecorded matters, such as fraud or forgery.
